Contracting Policy Notice 2017-5: Amendments to the Government Contracts Regulations

Amendments to the Government Contracts Regulations

Summary

The Governor in Council recently approved changes to the Government Contracts Regulations, which came into effect on May 5, 2017. These changes and their explanations are detailed in the Canada Gazette.

In summary, the amendments correct some wording in the French version of the Regulations, modify the deemed terms to clarify who has the legal capacity to contract, and update the exception for pardons. The corresponding Regulatory Impact Analysis Statement (RIAS) also clarifies a possible misunderstanding that was identified in the RIAS that was published in 2011. 

The amended Regulations are available on the Department of Justice website.

Departments are encouraged to incorporate the updated deemed terms into their written contracts.
