Who can file a claim
You must file a claim for exemption with Health Canada under the Hazardous Materials Information Review Act if you want to be exempt from having to disclose confidential business information on your hazardous product's:
- safety data sheet (SDS)
- label, if applicable
A supplier, within the meaning of the Hazardous Products Act, may file a claim to be exempt from disclosing one or more of the following:
- the chemical identity of a hazardous ingredient
- the concentration of a hazardous ingredient
- the name of a toxicological study that identifies a hazardous ingredient
An employer who is subject to the Canada Labour Code and/or provincial/territorial occupational health and safety legislation may file a claim to be exempt from disclosing one or more of the following:
- the chemical identity of a hazardous ingredient
- the concentration of a hazardous ingredient
- the name of a toxicological study that identifies a hazardous ingredient
- the product identifier, being its:
- chemical name
- common name
- generic name
- trade-name
- brand name
- information in respect of a hazardous product, other than the product identifier, that constitutes a means of identification
- information that could be used to identify the supplier of a hazardous product
