Directive on employment of legal counsel, technical adviser and assistants by the Communications Security Establishment Commissioner
1. Effective date
The Directive takes effect on June 03, 2016.
2. Application
This Directive only applies to the Office of the Communications Security Establishment (CSE) Commissioner.
3. Context
The Ineligibility and Suspension Policy enables Public Works and Government Services Canada (PWGSC) to issue Directives with respect to any aspect of the . Directives are used for such purposes as elaborating on or clarifying aspects of the, such as establishing monetary thresholds for, or identifying classes of contracts and real property agreements excluded from application of the Policy.
4. Directive statement
4.1 Objective
To exclude all contracts for legal counsel, technical advisers and assistants as the CSE Commissioner (the Commissioner) considers necessary for the proper performance of his or her duties as Commissioner from application of the Ineligibility and Suspension Policy and the integrity clauses.
4.2 Expected results
This exclusion from application of the policy takes into consideration the powers granted to the Commissioner in the National Defence Act and aligns with the full independence of the Office of the CSE Commissioner, acting at arm's length from government.
5. Requirements
The Ineligibility and Suspension Policy and integrity clauses do not apply to service contracts for legal counsel, technical advisers and assistants as the Commissioner considers necessary for the proper performance of his or her duties as Commissioner.
