Victim impact statement

What is a victim impact statement?

A Victim impact statement is a written or oral statement presented to the court at the sentencing of the defendant. Many times, victims, their family members and friends of the victim participate in both written and verbal statements.

Victim impact statements were created as an opportunity for the judge to hear how a criminal action has affected you and those you love. Victim impact statements are not limited to the courts. This is not the same as a victim statement, which is submitted to Parole Board of Canada members outlining any concerns victims have for their safety, that of families or their communities should an offender be granted parole.

A person who has suffered harm or physical or emotional loss as a result of the offence can prepare a victim impact statement, as can survivors of a deceased victim.

Police will give the victim a form to complete or refer you to a victim services agency to walk you through the forms and procedures to submit a victim impact statement. The process varies in each province and territory.

The Crown prosecutor and defence lawyer may ask you questions about it.

A copy of the statement is also provided to the offender.
