The grievor disagreed with his release from the Canadian Armed Force (CAF). He stated that allegations made against him in a Progress Review Board (PRB) were a result of a biased and unfair environment during his Basic Military Officer Qualification (BMOQ) course. The grievor submitted that the convening of the PRB and the many notes to file he received were a form of retaliation for having submitted a harassment complaint against the Directing Staff. Initially, he had requested investigations into his treatment, reinstatement in the CAF, and financial compensation for the mistreatment he endured as redress. Upon being informed that his release would be cancelled and he could re-attempt completing BMOQ, however, the grievor clarified that his request for reinstatement in the CAF would not be satisfied if he were required to restart BMOQ in the same toxic environment.

The Commander Military Personnel Generation Training Group, acting as the Initial Authority (IA), granted partial redress. The IA found that, except for the delays in the harassment complaint process, the actions of the Directing Staff were in accordance with policy and protocol. While the IA explained that all course requirements must be met to be granted the BMOQ, the IA directed reimbursement of any bona fide medical expenses and out-of-pocket expenses incurred as a result of the grievor's changed anticipated return date and confusion surrounding his release date. 

The Committee found that, on a balance of probabilities, the reasons provided to release the grievor under item 5(d) were justified and not based on a biased an unfair environment. The Committee also found that the grievor had made a personal decision not to re-attempt BMOQ and that there was insufficient evidence to support a recommendation that he be granted an equivalency as he had not successfully met all training requirements. Regarding the changes to the grievor's release date, the Committee found that a designated Release Authority can cancel or amend a release date and/or item up to and including the member's release date. The Committee found the grievor had not been aggrieved and recommended that the Final Authority not afford him redress.
