The grievor argued that the omission of a specific Chief Warrant Officer (CWO) position from Compensation and Benefits Instructions for the Canadian Forces (CBI) 204.531 resulted in his position not being entitled to Search and Rescue (SAR) Technician (Tech) specialist pay. The grievor argued that the position should be entitled to SAR Tech specialist pay when filled by a member who was a SAR Tech before occupationally transferring to the CWO corps.

The Initial Authority did not render a decision within the timeframe specified under article 7.15 of the Queen's Regulations and Orders for the Canadian Forces and the grievor requested that the grievance be forwarded to the Final Authority (FA) for consideration.

The Committee determined that the CWO position did not execute a SAR Tech function as required by the CBI and found that the grievor's position was consequently not entitled to SAR Tech specialist pay. The Committee recommended that the FA not afford redress.
