The grievor, a Reserve Force officer, contended that while some of her peers from the same basic occupational qualification course had been subsequently promoted without a second qualification, she had been obliged to obtain hers before she was promoted. The grievor argued that the second qualification was not needed for any officer in her occupation to be promoted, and that all officers in the occupation should be treated in the same manner, that is to be promoted without the second qualification. As redress, the grievor sought to have her effective promotion date backdated to the completion of her basic occupational qualification course, with the corresponding issuing of back pay and adjustments to rank seniority dates.

The Commander of the Reserve Force element, acting as the Initial Authority, denied the grievance, finding that the grievor was subject to the regulations that were in effect at the time of her promotion. 

The Committee confirmed that the grievor's peers were promoted without having obtained the second qualification which she had been required to complete for her own promotion. Given that the grievor was in the same circumstances at the completion of her basic occupational qualification as her peers who were promoted, the Committee found that there was no reason for her to be treated differently. As a result, the Committee concluded that the grievor had been aggrieved.

The Committee recommended that the Final Authority grant redress.
