# 2021-111 Careers, Harassment, Repatriation

Harassment, Repatriation

Case summary

F&R Date: 2021-12-09

The grievor argued that the decision that resulted in his Category D (Cat D) repatriation from an operation was based on untruthful and unverified sexual harassment allegations. The grievor requested that his good reputation be restored and that all false sexual harassment allegations be removed from his service record. The grievor added that the decision-makers did not provide him with full disclosure and, as such, denied him an opportunity to adequately respond.

The Initial Authority did not render a decision as the grievor opted to forward his grievance to the Final Authority (FA) after four months had passed.

The Committee reviewed all of the allegations made by each of the complainants and found the harassment complaints made against the grievor to be credible. The Committee also found that the grievor's actions towards female subordinates caused a decline in morale and cohesion on the team as his presence and actions made them feel uncomfortable in the workplace. Furthermore, the Committee found that the grievor either misrepresented or failed to correct erroneous understanding of his chain of command in theatre regarding the grievor's employment. In light of the above, the Committee found that the decision that resulted in the grievor's Cat D repatriation was reasonable.

The Committee recommended that the FA not afford the grievor redress.

FA decision summary

The Chief of the Defence Staff agreed with the Committee's findings and recommendation not to afford the grievor redress.
