The grievor was the training officer at a cadet squadron. Following a number of complaints from cadets and parents, the grievor received an initial counseling (IC) that cited five instances in which the grievor's conduct had been deficient. The grievor challenged the IC.
The Initial Authority found that the IC was reasonable and that the grievor had been treated fairly and in accordance with the applicable policy.
The Committee found that three of the five instances listed in the IC were performance rather than conduct deficiencies and the appropriate administrative action would have been to document the shortcomings and provide the grievor a reasonable period to reach the expected level of performance. The Committee also found that one of the instances was described in insufficient detail to allow for meaningful review and should be quashed. Lastly, the Committee found that only one of the instances documented in the IC was a conduct deficiency.
Ultimately, the Committee recommended that the IC be quashed and that a new IC be issued to address the one instance of the grievor's conduct deficiency, as identified in the Committee's analysis.
