The grievor challenged the decision made by the Canadian Armed Forces Dental Care Plan Board not to reconsider Great West Life's denial of his dental claims. The grievor maintained that he had been up front about his other family health care plan. The grievor also maintained that it was the Orderly Room’s (OR) mistake not to advise him that he was not eligible for benefits under the Reserve Dental Care Plan (RDCP).

The Initial Authority denied the grievor redress asserting that, as the grievor already had dental coverage, he was not eligible to participate in the RDCP. 

The Committee found that the grievor's subscription to another health care plan rendered him ineligible for RDCP. The Committee noted that while the OR did make mistakes, they did not make any negligent misrepresentations that the grievor relied on to his detriment.

The Committee recommended that the Final Authority (FA) deny the grievor redress.
