The grievor challenged the decision to end his Phase II Harvard pilot training following a Progress Review Board (PRB). As redress he requested remedial training to complete Phase II or, alternatively, that another PRB be convened in accordance with applicable policy. The Initial Authority found that the decision to end the grievor's training was appropriate under the circumstances.

The Committee carefully reviewed the grievor's flight records and other applicable documentation in accordance with 1 Canadian Air Division Order 5-035 and the Harvard Phase II Pilot Training Plan. It found that the evidence supported the conclusion that the grievor met course fail criteria after exhausting his remedial opportunities.

The Committee also determined that the PRB Chair, who had been the grievor's Course Director, addressed a potential apprehension of bias by recusing herself from a decision-making role, and that the PRB provided the grievor with appropriate notification and the opportunity to offer representations. Accordingly, the Committee found that the PRB process was procedurally fair.

The Committee recommended that the Final Authority not afford the grievor redress.
