The grievor contested the decision to cease his Phase (Ph) II Harvard pilot training due to course failure. The grievor argued that aircraft unavailability and flying continuity impacted his training progression and his course serial was less successful than the serials before and after his.

The Commander, 2 Canadian Air Division, acting as the Initial Authority (IA), concluded that the grievor's flying continuity was in line with what other students experienced. The IA also found that the grievor's training was conducted in accordance with the Integrated Training Plan (ITP). The IA determined that the decision to cease the grievor's training was in accordance with the applicable policies. The IA did not afford redress.

The Committee found that the grievor's Ph II training was conducted in accordance with the ITP. The Committee also found that the management of other course serials was not pertinent to an assessment of whether the grievor's training was conducted in accordance with the ITP.

The Committee found that the grievor's Progress Review Board was conducted in accordance with the ITP and applicable policies, its findings were supported by reliable evidence, and its recommendation that the grievor cease training was reasonable and justified.

The Committee recommended that the Final Authority not afford the grievor redress.
