The grievor argued that she was unfairly treated by her Commanding Officer (CO)'s decisions that included the cessation of her training and the initiation of an Air Operations File Review (AOFR).

The Initial Authority (IA) indicated that the grievor's CO reasonably assessed the grievor's performance and made decisions about her career that were in accordance with the applicable rules and regulations. The IA added that in spite of the remedial training she received, the grievor was unable to overcome difficulties related to with essential abilities for pilot.

The Committee found that the grievor was unfairly treated when her training was ceased and by the initiation of an AOFR. The Committee's analysis showed that none of the conditions prescribed to justify the initiation of an AOFR applied to the grievor's circumstances and as such, was contrary to the policy.

The Committee recommended that the Final Authority afford the grievor redress.

FA decision summary

The Director Canadian Forces Grievance Authority, acting as Final Authority (FA), agreed with the Committee's finding that the grievor had been aggrieved and with its recommendation to set aside the Air Operations File Review (AOFR). The FA found that the grievor was disadvantaged by her shorter than average tour length, and the requirement that her training be expedited. Further, it was unreasonable for the grievor's CO to immediately impose an AOFR following training failure without using the corrective measures at his disposal. The FA directed that the AOFR be removed from the grievor's file, and that the grievor be posted to a squadron to continue training, if that was still within her career interest.
