The grievor complained of not receiving the expected points at several promotion boards and sought confirmation of those promotion board results dating back to when the grievor entered the promotion zone in 2012.

The Initial Authority (IA), the Acting Director General Military Careers, found that the grievor had not received the full point entitlement in the 2018 promotion board. The IA declined to re-assess the 2017 promotion board, as the grievor was excluded due to medical employment limitations. The IA further explained that prior promotion board results were deemed to be outside the time limit for submission of a grievance as outlined in Queen's Regulations and Orders for the Canadian Forces 7.06 - Time Limit to Submit Grievance.

The Committee found that after the grievor discovered possible discrepancies in the board scores, the grievance was submitted within the applicable time limit. The Committee also found that the grievor was justified in questioning the accuracy and fairness of all previous promotion board scores. The Committee also determined that the grievor was incorrectly excluded from the 2017 promotion board and noted that the Director of Military Careers and the Director Support Services recognized this systemic issue and that cases were still being analyzed for supplementary boards.

The Committee analyzed the scoring criteria and the promotion board results from 2012 to 2018 and found that the grievor warranted score increases in the 2015-2018 boards. The Committee then found that the grievor still would not have been promoted between 2015-2017 based on the number of promotions that occurred in those years. Finally, the Committee found that the grievor merited promotion in 2018 but had been unjustly denied promotion due to an upcoming medical release in 2019. The Committee recommended that the grievor be promoted retroactive to 2018.
