The grievor, a master corporal, alleged that during different periods he had carried out the full spectrum of duties and responsibilities of his superior who held the rank of sergeant (Sgt). Consequently, he was asking for compensation for the rank of Sgt for the periods he fulfilled the full spectrum of duties and responsibilities for his position as well as those of his superior.

In some similar grievances, the Chief of the Defence Staff (CDS) waived three of the six criteria stipulated in Canadian Forces General Message 060/00— Acting Pay/Rank and used his discretionary authority to grant the grievors a promotion to an acting rank while so employed.

In this case, the Committee concluded that, for one of the periods in question, the grievor met the three criteria used by the CDS to grant a promotion to the grievors in similar grievances. More specifically, the grievor had held a position established at a higher rank and was assigned the full spectrum of responsibilities and authorities normally associated with the higher rank for a period of 90 days.

The Committee therefore recommended to the Final Authority (FA) that the grievor be granted a promotion to the acting rank of Sgt for a period of 90 days.
