The grievor, a Primary Reserve (P Res) officer, was disputing his withdrawal from a career course after the Canadian Army Command and Staff College (CACSC) discovered that he did not have all of the prerequisites for the course; in addition, he was disputing their subsequent denial of his training waiver request. He mainly alleged that his withdrawal was unfair, as certain prerequisites were not required before he was nominated for the course and his waiver request was not processed within a reasonable timeframe.

The Commander Canadian Army Doctrine and Training Centre, serving as the initial authority (IA), denied the grievance. The IA found that the withdrawal was justified, as the prerequisites were already established. In addition, it was determined that the grievor had not completed those prerequisites and that, despite the processing delay, his waiver request did not provide an adequate justification to permit its authorization.

The Committee found that, given that the course prerequisites were clearly established and that the grievor did not have any of them, the grievor's nomination by his chain of command went against Canadian Army Orders (CAO) 24-08 and 24-10. The Committee also found that it was reasonable to refuse the grievor's waiver request given that it was incomplete and did not comply with CAO 24-10. As such, the Committee found that the grievor's withdrawal was justified.

Although the Committee can concede that the processing of the grievor's waiver request did not comply with the timeframes set out by CAO 24-10, it was satisfied with the CACSC's commitment to respecting the timeframes from now on while maintaining a flexible registration process for P Res members.

The Committee recommended that the grievance be denied.
