The grievor argued that the Initial Counselling (IC) and Personnel Development Review (PDR) he was issued were inaccurate and unsubstantiated. He also contended that the narrative of his Personnel Evaluation Report (PER) was inconsistent with the scores he received.

The grievor's Officer Commanding stated that, although there was conflicting information, he had the required degree of certainty that the grievor had committed conduct violations, and he therefore placed him on an IC to ensure he would be appropriately monitored; and, reported the conduct in his PDR.

The Committee found that there was a lack of investigation and insufficient reliable evidence to conclude that the grievor's conduct was below the required standard. The Committee therefore concluded that there was no substantiation for the IC or the adverse PDR. In regards to the PER, the Committee found that the grievor had failed to provide any evidence to support his request for higher scores.

The Committee recommended that both the IC and the PDR issued to the grievor be rescinded and removed from his personnel records.

FA decision summary

The Director - Canadian Forces Grievance Authority agreed with the Committee's findings and recommendation, and therefore directed that the grievor's IC and PDR, as well as all documents related thereto, be removed from his personnel file.
