The grievor considered Canadian Forces Base (CFB) Halifax to be the only CFB enforcing paid parking, claiming its parking policy runs contrary to the Income Tax Act and is unfair. The grievor requested that a Canada-wide parking policy be implemented based on a nationally averaged Fair Market Value (FMV). In the alternative, he requested that CFB Halifax revert to free and scramble parking for employees.

The Initial Authority (IA) determined that the parking rates were set using the best information available at the time and complied with government direction.

The Committee found that, based on Government and Departmental direction, CFB Halifax was required to determine a FMV, implement a parking policy and establish a parking committee. The Committee determined that the FMV was required to be set in accordance with local conditions and concluded that an average national FMV could not be supported.

The Committee also explained that the Base Commander had exercised his discretion to not implement scramble parking and found his decision reasonable.
