# 2016-005 Careers, Compassionate Posting

Case Summary

The grievor requested a compassionate posting as he needed temporary geographical stability in order to create the family cohesion required to resolve his mobility issues. His request was denied by the Director Military Careers (D Mil C), based on the social worker report which indicated that although the grievor's circumstances were exceptional, there was no indication that his situation could be resolved within two to three years as established by Defence Administrative Orders and Directives (DAOD) 5003-6. The D Mil C also indicated that there was no position available within the grievor's military occupation at the requested geographical location.

The Initial Authority denied the grievor's redress, indicating that his request did not meet the criteria established in the applicable policy for compassionate status and compassionate postings.

The Committee reviewed DAOD 5003-6 and found that the policy does not restrict the compassionate posting of a CAF member to a position within his or her military occupation. Given the core principles that form the basis of the policy, the Committee found that it was designed to be flexible, while recognizing the personal needs and the well-being of CAF members. Thus the decision of D Mil C to limit the grievor's compassionate posting to his military occupation was overly restrictive and somewhat contrary to policy.

The Committee also noted that while there was no certainty that the grievor's situation would be resolved within the two-year period, this was not a sufficient reason to automatically deny a compassionate status and compassionate posting request of this nature.

The Committee recommended that the grievor be granted a two-year compassionate posting.
