The grievor challenged his non-selection for a posting outside Canada (OUTCAN). He argued that he was unfairly rated in the selection process and lost points for criteria that were beyond his control, such as his existing terms of service and the fact that he did not have an operational tour, although he had applied for some. He also contended that the screening criteria for OUTCAN postings should be published in order to allow members to meet the criteria.

The Director General Military Careers acted as the Initial Authority (IA) and denied the grievance. The IA explained that the aim of the Career Manager (CM) is to have the right person in the right position at the right time. He further explained that it was within the CM's purview to develop selection criteria to assist in identifying the right person for a particular position; and, that the selection criteria may change from year to year based on the requirements of the positions. The IA found that the grievor's file was fairly considered but he was not selected.

The Committee agreed with the CM's objectives, but found that the matrix used by the CM, while no doubt well intended, was not really helpful in generating the desired effect. The Committee found that the grievor's file was considered in competition with his peers but was unable to conclude that he was the best fit for the available positions, or that he was treated unfairly. The Committee recommended that the grievance be denied.

The FA agreed with the Committee's findings and recommendation that the grievance be denied. Furthermore, the FA found value in the Committee's advice that the process used to select CAF members for OUTCAN postings be somewhat harmonized and similar across the board. The FA asked DGMC to consider this advice to improve the administration of this function.
