The grievor, a student pilot, was posted from Canadian Forces Base Winnipeg to 15 Wing Moose Jaw to attend Phase II Harvard Pilot Training. He sought to have the posting changed to an attached-posting but was denied. The grievor submitted a grievance stating that since his Phase II pilot training was under one year in duration, he should have been attached-posted to Moose Jaw. As remedy, he requested an attached-posting and reimbursement for rations and incidentals.

The Initial Authority (IA) denied redress. Referring to the A-PM-245, Chapter 7, Annex A, the IA explained that since the training at 2 Canadian Forces Flying Training School was in excess of six months duration, a posting was authorized. Notwithstanding each student's personal preference, the IA pointed out that it is ultimately the Training Authority (TA) who decides which flying stream each student enters following Phase II training. The IA further explained that there is an expectation that all eligible students may be selected to fly fast jets, therefore the training in Moose Jaw could well extend beyond one year.

The Committee disagreed with the grievor's assertion that any student on a course for under one year should be on attached-posting status.The Committee found that the policy permitted the TA to use either a posting or an attached-posting to assign pilots to Moose Jaw for Phase II, and that the TA is obligated to determine the method of assignment that best serves the military needs of the Royal Canadian Air Force. Finally, the Committee found that posting the grievor to Moose Jaw for his Phase II training was reasonable and appropriate and that the grievor was treated fairly in the matter. The Committee recommended that the grievance be denied.
