The grievor, a Regular Force Direct Entry Officer, injured her back during her Basic Military Officer Qualification (BMOQ) Training course and was removed from the course for medical reasons. The grievor argued that it was unfair that she was held at the rank of Second-Lieutenant and the same pay increment (PI) for several years given that the reason for the delay in completing her training requirements was beyond her control.

There was no Initial Authority (IA) decision for this grievance because the grievor refused to provide the IA with additional time to respond.

The Committee found that the grievor's occupational training was delayed by the injury that she suffered during her BMOQ training.

The Committee then noted that the Compensation and Benefits Instructions (CBI) 204.211(12) states that if the completion of a member's occupational training is delayed, “…solely as a result of a delay from scheduling of the training or a change in training requirements in the military occupation”, the member may be granted additional PI. Noting that the policy offers no flexibility regarding any other reason for a delay in training, the Committee found that the grievor was not eligible to be granted any additional PI under the provisions of CBI 204.211(12), and recommended that the grievance be denied.
