Notice – Coming into force of new document seizure authorities

Ottawa, December 6, 2018 — New document seizure authorities adopted as part of Bill C-6, An Act to amend the Citizenship Act, which received Royal Assent in June 2017, are now in force.

These provisions provide clear authority under the Citizenship Act for citizenship officers to seize and detain documents believed to be fraudulently or improperly obtained or used. Changes have also been made to the Citizenship Regulations to provide for clear and consistent procedures related to the seizure, retention and disposal of the documents.

These changes enhance and protect the integrity of the citizenship program, and assist in preventing fraud or improper use of documents. Giving clear authority for citizenship officers to seize documents helps IRCC carry out investigations where fraud is suspected and assists decision makers in determining whether applicants meet the requirements for Canadian citizenship.

The regulatory changes also include some additional technical amendments, including aligning with other amendments made to the Citizenship Act through Bill C-6.
