On June 27, 2023, IRCC announced Canada’s first-ever Tech Talent Strategy to help businesses in Canada thrive in a competitive landscape by ensuring they have the talent they need, when they need it. One of four pillars under the Strategy is the Open Work Permit for H-1B Visa Holders initiative.
As of September 30, IRCC received approximately 14,200 applications from H-1B visa holders and their family members, and has already approved approximately 6,100 applications for these highly talented individuals and their families to come to Canada.

On July 16th, IRCC launched the open work permit for H-1B Specialty Occupations visa holders, with additional work and study permit options for eligible family members. The intake cap of 10,000 applications was reached within two days of its launch, demonstrating that Canada remains a top destination for highly-skilled workers.
Approved applicants will receive an open work permit of up to three years in duration, allowing them to work for almost any employer anywhere in Canada. In line with Canada’s commitment to family reunification, their spouses and dependants are also eligible to apply for a temporary resident visa, with a work or study permit, as needed.
Thousands of workers in high-tech fields are employed with companies that have large operations in both Canada and the United States (US). This measure will expand opportunities available for skilled workers to continue to pursue their careers in the high-tech sector and contribute to economic growth and prosperity in North America.
IRCC continues to process applications under this measure, and will continue to welcome these high-skilled workers in the coming months.

No decision has been made regarding an increase to the intake cap for the open work permit for H-1B visa holders. Should a decision be made, further information will be shared publicly.
