Referring cases to the Canada Border Services Agency for potential cessation or vacation of refugee protection

New instructions are now available to better assist CIC officers in referring cases to the Canada Border Services Agency (CBSA) for potential cessation or vacation of refugee protection.

Cessation and vacation have been part of the Immigration and Refugee Protection Act (IRPA) since its inception in 2002. The following enhanced measures to better enforce both cessation and vacation were recently introduced as part of the Refugee Reform:

  • the loss of permanent residence status if refugee protection ceases under A108(1)(a) to (d) and if inadmissibility is established under A40.1.

    Note: there is no loss of permanent residence status if refugee protection ceases due to changes in country conditions [A108(1)(e)].

  • the temporary funding provided to the CBSA as part of the Refugee Reform to support the enforcement of the cessation and vacation program over the next three years.
