Background

The Subsequent updated Temporary public policy to grant permanent residence to certain individuals in Canada who came to Canada under the age of 19 and were under the legal responsibility of the child protection system facilitates the granting of permanent residence for eligible applicants within this population, and their in-Canada family members, in recognition of the vulnerability they may face, including being removed from Canada.

Public Policy Considerations

Given the vulnerability of this population, applicants may not have sufficient resources to pay the required fees, including the application processing fee for permanent residence, and the biometrics collection fee.

This public policy grants fee exemptions to eligible principal applicants and their family members to minimize the financial burden for this population and their families when applying for permanent residence.

I hereby establish that, pursuant to my authority under section 25.2 of the Immigration and Refugee Protection Act (the Act), there are public policy considerations that justify the granting of exemptions from the provisions of the Immigration and Refugee Protection Regulations (the Regulations) listed below to foreign nationals who meet the conditions (eligibility criteria) set out below.

Conditions (eligibility requirements)

Based on public policy considerations, delegated officers may grant exemptions from the requirements of the Regulations listed below, if the following condition is met:

  • The foreign national has submitted an application form for permanent residence under the Subsequent Updated Temporary public policy to grant permanent residence to certain individuals in Canada who came to Canada under the age of 19 and were under the legal responsibility of the child protection system signed on November 28, 2024 or the Updated Temporary public policy to grant permanent residence to certain individuals in Canada who came to Canada under the age of 19 and were under the legal responsibility of the child protection system signed on January 19, 2024.

Provisions of the Regulations for which an exemption may be granted:

  • Paragraph 10(1)(d) of the Regulations – the requirement to provide evidence of payment of the applicable fees;
  • Section 307 of the Regulations – the requirement to pay the application processing fee for examining circumstances under subsection 25.2(1) of the Act; and
  • Subsection 315.1(1) of the Regulations – the requirement to pay for the provision of service in relation to the collection of biometric information.

Effective Date and Expiration

This public policy replaces the Updated temporary public policy concerning the fees for applicants of the temporary public policy to grant permanent residence to certain individuals in Canada who came to Canada under the age of 19 and were under the legal responsibility of the child protection system signed on January 19, 2024.

It takes effect upon signature and expires on January 21, 2027. This temporary public policy may be revoked at any time.
