Notice: Publication of the Guidance Document: Certificates of Supplementary Protection

Health Canada is pleased to announce an update to the Guidance Document: Certificates of Supplementary Protection.

The Office of Patented Medicines and Liaison (OPML), within the Office of Submissions and Intellectual Property, administers sections 104 to 134 of the Patent Act and the Certificate of Supplementary Protection Regulations (CSP Regulations).

The Guidance Document has been amended to clarify that the patent expiry date is the date on which the term of the patent expires under section 44 of the Patent Act and clarify current practices, including the definition of "filing date".
