Description of the alleged contravention of the order
Orange TKO Industries (INT'L) Inc. is alleged to have failed to comply with an Order by the Minister to recall a product as per subsection 31(1) of the Canada Consumer Product Safety Act. Specifically:
- A list of all products that Orange TKO Industries (INT'L) Inc. manufactured, imported, advertised, or sold as "Orange TKO Super Concentrated All Purpose Cleaner" (all sizes/volumes) was not provided to Health Canada within the time specified in the order.
- A copy of Orange TKO Industries (INT'L) Inc.'s distribution list containing the names and addresses of all clients in Canada to whom Orange TKO Industries (INT'L) Inc. has sold the product was not provided to Health Canada within the time specified in the order.
- A "Recall Notice" document was not completed by Orange TKO Industries (INT'L) Inc. and provided to Health Canada within the time specified in the order.
