Consultation on the Legislative Review of the Tobacco and Vaping Products Act

The purpose of this consultation was to gather perspectives on the operation of the vaping-related provisions of the Tobacco and Vaping Product Act (TVPA), with a particular emphasis on protecting young persons.

A key part of this consultation was to gather the perspectives of Canadians, experts, and other stakeholders relating to the operation of the TVPA, with a particular emphasis on the Act's ability to address youth vaping.

Who was the focus of this consultation

Health Canada engaged with Canadians, including:

• the general public
• provincial and territorial governments
• health partners
• tobacco control experts - domestic and international
• non-governmental organizations
• academics
• people who vape, use tobacco products, or use both vaping and tobacco products
• interested members of the industry

The Tobacco and Vaping Products Act (TVPA) came into force on May 23, 2018. It amended the former Tobacco Act, which was originally enacted in 1997. The TVPA created a new legal framework, in conjunction with other pieces of federal legislation, to respond to the increasing availability of vaping products (with and without nicotine) in Canada and to help ensure that Canadians would be appropriately informed about and protected from the risks associated with these products.

As an added safeguard, the TVPA includes a requirement to undertake a legislative review of its provisions and operation three years after coming-into-force, and every two years thereafter. The public consultation will help support the evidence-based analysis and review of the legislation.
