Consultation: Notice of intent to amend the regulations to address health product shortages in Canada

Opened from June 25 to July 25, 2024.

Health Canada is proposing to amend the Food and Drug Regulations and the Medical Devices Regulations to:

  • help prevent shortages of drugs and medical devices for human use
  • reduce the impacts of shortages that can't be prevented

Who is the focus of this consultation

The Government of Canada will engage with:

  • provincial and territorial governments
  • drug and medical device manufacturers, distributors and importers
  • health care system partners
  • the general public, including patients and families

Key areas for discussion

Health Canada is looking to amend the Food and Drug Regulations and Medical Devices Regulations to give us more tools to use so we can:

  • better prevent shortages before they occur
  • reduce the impacts of shortages that can't be prevented

Through the proposed regulatory amendments and other planned actions over the next 4 years, we want to:

  • design systems and procedures that promote readiness and rapid response to shortages
  • detect shortage risks and intervene to help avoid shortages before they happen
  • detect shortage signals early so we can minimize the impacts of shortages when they occur and restore access to needed products quickly
