Makwa Sahgaiehcan First Nation fined $100,000 for environment violation

Environment and Climate Change Canada (ECCC) is a diverse, science-based organization responsible for the protection of our environment.
On October 6, 2016, the Makwa Sahgaiehcan (Loon Lake) First Nation pleaded guilty, in Saskatchewan Provincial Court, for failing to comply with an environmental protection compliance order (EPCO) issued by ECCC. The court fined the Makwa Sahgaiehcan (Loon Lake) First Nation $100,000. The funds will be directed to the Environmental Damages Fund.
The order was issued following an inspection by enforcement officers, at Loon Lake Fine Foods, to ensure compliance with the Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations (STSR). The First Nation was directed to take measures to comply with the STSR; charges were laid under the Canadian Environmental Protection Act, 1999 (CEPA) after it was determined that they failed to comply with the terms of the order.

- EPCOs may be issued under CEPA by ECCC enforcement officers to direct that various measures be taken to stop or to prevent the commission of an alleged contravention.
- The purpose of the STSR is to reduce the risk of contaminating soil and groundwater due to spills and leaks of petroleum products from storage tank systems.
