LANXESS Inc. certifies that the request that information provided in the Notice of Objection and Request for the Appointment of a Board of Review in relation to the Proposed Order to add Propanedinitrile, [[4-[[2-(4-cyclohexylphenoxy)ethyl]ethylamino]- 2-methylphenyl]methylene- (CHPD) to Schedule 1 to the Canadian Environmental Protection Act, 1999 ('CEPA') filed on November 19, 2008, be treated as confidential under sction 313 is hereby withdrawn, and consents to the publication to the CEPA Environmental Registry of the said Notice.
