Personal protective equipment regulatory initiative – summary of changes
Issue
Federal Occupational Health and Safety (OHS) regulations under the Canada Labour Code contain outdated and inconsistent Personal Protective Equipment (PPE) and fall-protection requirements, making compliance difficult especially when multiple regulations may apply. This has also led to misalignment with provincial and territorial OHS requirements. Inconsistencies can increase costs, hinder labour mobility, and increase the risk of injury when PPE fits poorly.
Goal
The proposed regulations aim to improve worker health and safety in federally regulated workplaces by simplifying and aligning OHS requirements, modernizing PPE standards, and ensuring PPE achieves proper fit on employees.
Proposed changes
The Labour Program is proposing updates to six regulations to clarify and improve worker protection related to PPE and fall prevention. The regulations changing are:
- Canada Occupational Health and Safety Regulations
- Aviation Occupational Health and Safety Regulations
- Maritime Occupational Health and Safety Regulations
- On Board Trains Occupational Health and Safety Regulations
- Oil and Gas Occupational Safety and Health Regulations
- Administrative Monetary Penalties (Canada Labour Code) Regulations
The following sections provide a summary of the proposed changes:
Ensuring proper fit of PPE
Depending on the regulation, updated language would either add or introduce new requirements to ensure that a qualified person considers key factors, such as body dimension, when properly fitting PPE to an employee.
Safety standards
Modernizing PPE technical standards will help achieve consistency across the federal OHS regulations and align the federal PPE technical standards with the provinces and territories.
Fall protection
In addition to updating technical standards for fall-protection equipment, the changes make definitions clearer, improve wording, and—where not already needed—introduce the need for a fall-protection plan and the use of a hierarchy of fall-protection systems to prevent falls.
Training and instruction
Training for PPE must come from a qualified person, now matching the requirement already in place under the COHSR.
While Employers still need to keep a written record of the training, this record would consist of a summary and need to be accessible to everyone in the workplace.
Simplifying PPE requirements
To reduce confusion, PPE requirements and terminology become more consistent where possible across the regulations and adopt the common terms used by the provinces, territories, and industry.
Administrative Monetary Penalties (Canada Labour Code) Regulations
Changes to Schedule 1 of the AMPs Regulations remove designations for requirements no longer necessary and add violation types for new requirements introduced.
