Canada Labour Code prosecutions: Canadian National Railway Company (CN) – Gutah Camp

On November 28, 2012, a conductor was riding a tank car that he was switching onto a siding at the Canadian National Railway Company (Gutah Camp) in Fort St. John, British Columbia. The tank car derailed and killed him when it rolled over. The Labour Program of Employment and Social Development Canada laid four charges against CN Gutah on November 15, 2013. On June 2, 2016, CN Gutah was convicted with one count of failure to ensure the health and safety of an employee. CN Gutah was acquitted on two counts, after the fourth count had been dropped. Crown filed an appeal on the acquittal of the two counts. On April 6, 2017, the conviction of CN Gutah on one count was upheld, which carries a fine of $100,000. The acquittals on the other charges were also upheld.
