Canada Labour Code Prosecution: Don Anderson Haulage Ltd.

On October 15, 2014, four employees were assembling a customized transport trailer that was going to be used to transport an over-sized load from Hamilton, Ontario to Princeville, Quebec. While three of the employees were positioning the 3,400-lb.steel beam with an overhead crane, the beam toppled and fell on the fourth employee’s leg, causing multiple fractures and injuries. Following the investigation, legal proceedings were initiated. On October 11, 2016 five charges were laid against Don Anderson Haulage Ltd. Don Anderson Haulage Ltd. pleaded guilty to one charge of failing to provide necessary training to the crane operator, which led to the victim’s leg being crushed, thereby breaching subsection148(2) of the Canada Labour Code. As a result of the guilty plea, the employer was ordered to pay a fine of $70,000 and all other remaining charges were withdrawn.
