The Military Police (MP) is independent of the chain of command in policing matters. Members of the MP performing policing functions are under the full command of the Canadian Forces Provost Marshal, which allows them to perform law enforcement duties independently. In the case of an inappropriate interference in the conduct of an MP investigation, a complaint can be made to the Military Police Complaints Commission, which has the powers to investigate the complaint independently.

Canadian Forces National Investigation Service

Mandate

The mandate of the Canadian Forces National Investigation Service (CFNIS) is to investigate serious and sensitive matters in relation to National Defence property and Canadian Armed Forces (CAF) personnel serving in Canada and abroad. The CFNIS has authority and jurisdiction over offences (serious and sensitive matters) that occur on a Defence Establishment, as well as, persons who are subject to the Code of Service Discipline, wherever they are established or deployed throughout the world, regardless of rank or status.

Command and control

The Commanding Officer of the CFNIS reports directly to the Canadian Forces Provost Marshal. Regardless of the circumstance or environment, the members of the CFNIS remain under the Provost Marshal’s command. This reporting structure allows the CFNIS to conduct thorough investigations in a fair and impartial manner.

Investigative process

Usually, requests for CFNIS involvement come through regular Military Police organizations, but CAF members and DND employees can lay complaints, or communicate directly with regional offices or individual CFNIS members. Once the CFNIS becomes aware of allegations of a potential criminal or service offence, the organization immediately conducts a review of the information to determine whether or not a CFNIS investigation should be conducted.

Once it is determined that CFNIS involvement is warranted, then the CFNIS investigators interview the source of the complaint and begin the investigative process. The goals of the investigation are to reconstruct events, identify if an offence has been committed, identify those responsible for the offence and gather evidence to present to court. As with any other Canadian Police major crimes unit, the CFNIS then analyzes all of the gathered information, to determine if the available evidence warrants laying a charge.

How to file a Complaint

To report a crime, make a complaint or speak with a member of the CFNIS can be done by calling them directly. The members of the CFNIS undergo specialized training in areas such as sexual assault investigations, physical abuse, investigating offences against children and trauma informed care training. Also, they have the ability to protect and support victims of sexual assault by identifying, investigating, and providing policing services support to any resulting prosecutions of persons responsible for sexual offences. The CFNIS also runs its own internal Victims Assistance Program in support of investigations.
