Application: This is an order that applies to members of the Canadian Armed Forces and a directive that applies to Civilian Instructors and employees of the Department of National Defence employed with the Cadets and Junior Canadian Rangers Group, and cadets in the Sea, Army, and Air Cadet Programs.

3. Definitions

Charity/
Charitable Organization

A charity or charitable organization is any group which is organized for the purposes of bettering society and communities and/or members of those communities. They may be incorporated or unincorporated and have charitable status in accordance with the Income Tax Act, or not. For the purpose of this policy, the Cadet Leagues are considered charitable organizations.

Donor

A person who donates something of value to a person or an organization.

Local Committees

All three Cadet Leagues maintain local committees at the corps/squadron level. Local Committees are also known as Branches, Support Committees and Sponsoring Committees.

Service Clubs

A service club is a voluntary non-profit organization that is organized to carry out service and charitable works, often in support of the welfare of the local community, as well as provide various services for its members. Examples of such clubs include the Royal Canadian Legion, Lions International, Kiwanis International, Kin Canada, and Rotary International, amongst others.

4. Policy

Context

• 4.1 As a part of the Cadet Program, cadets are required to participate in community service which may include supporting community service clubs and other charitable organizations. To be considered community service, one must give without reward or compensation.
• 4.2 Support to Charities in general, and in particular to charities at the local community level, allows the Cadet Program to have a direct impact on Canadian society as a whole. Through these types of community-based activities, cadets learn to become active, responsible members of their communities.
• 4.3 When cadets partake in community service, they often have the support of the Cadet Leagues and Local Committees, which has been essential to the success of the Cadet Program over many years. The 2020 Memorandum of Understanding with the Cadet Leagues underlines the close and important historical relationship that exists in support of corps/squadrons. With this in mind, the CJCR Gp will continue to work closely with Cadet League fundraising efforts in support of the shared responsibilities outlined in the 2020 Memorandum of Understanding.

Policy

• 4.4 The participation of cadets and cadet families in any charity fundraising activity is voluntary. Fundraising and other support to charities are not considered to be an obligation nor a pre-requisite for youth participation in the Cadet Program.
• 4.5 When cadets participate in approved charitable and fundraising activities, all supervision requirements must be met in accordance with CJCR Gp Order 5001-0, Supervision of Cadets
• 4.6 CAF members and Civilian Instructors are authorized to supervise cadet activities to support fundraising activities, however, the participation by COATS members are limited to those parameters outlined in DAOD 7021-4, Solicitations, Sponsorships and Donations
• 4.7 Fundraising activities will not be conducted at the expense of training activities for the cadets and staff of each corps/squadron involved.
• 4.8 Participation of cadets in service projects where there is no exchange of funds, such as collection and sorting of non-perishable food for a food bank, is authorized and encouraged.

Restrictions

• 5.7 All licenses for fundraising must be in the name of the charity, and must not include the name of the corps or squadron.
• 5.8 In accordance with Chapter 6, Section 10, Badge ownership, reproduction and use, of the Heritage Structure of the Canadian Forces, all badges and other insignia are recorded in the Public Register of the Arms, Flags and Badges of Canada and cannot be used without authorization, pursuant to the National Defence Act, Trademarks Act and Copyright Act. In particular, the unauthorized use of badges in any advertising or in any trade or service is prohibited by Section 291 of the National Defence Act.
• 5.9 COATS members and cadets will not participate in fundraising through pyramid schemes, crowd funding/crowd sourcing and Go Fund Me accounts.
• 5.10 Cadets will not fundraise in proximity to casinos, cannabis stores, or enterprises whose principal purpose is the sale of alcohol, tobacco, or cannabis products in accordance with CATO 13-22, Smoking Policy, CATO 13-23, Drug and Alcohol Policy, CANCDTGEN 005/23,Amendment to CATO 13-23, Drug and Alcohol Policy, CANCDTGEN 13/08, Comd Natl CJCR Sp Gp Direction on Recreational Use and Possession of Cannabis within the Natl CJCR Sp Gp, and CANCDTGEN 007/19, Cannabis Direction Amendment 1.
• 5.11 Cadets may not participate in any activity where they are performing security-related tasks such as directing traffic, parking attendants, or crowd control which could present a greater personal risk to the cadet.
• 5.12 The Local Committee of the Cadet League is the steward of all funds that are intended to support the corps/squadron, as such, corps/squadrons will only accept cheques, donations, gift, or payments in the name of the Local Committee or appropriate level of the Cadet League, with the corps/squadron number in the memo/notes.
• 5.13 Cadets will not conduct fundraising activities which provide funds which solely support the administrative or organizational requirements of the charity beyond the elements contained in the 2020 Memorandum of Understanding with the Cadet Leagues.
• 5.14 Cadets will not conduct fundraising activities for the provision of awards, recognition, bursaries, and grants for cadets and corps/squadrons beyond those provided by the Local Committee.

6. COATS Members Responsibilities

• 6.1 COATS members must ensure that the nature of participation in any charitable activity will protect the name and reputation of the CAF, CJCR Gp, and Cadet Program.
• 6.2 Fundraising projects involving the participation of cadets must strive to meet the principle of value received, meaning that the exchange must be of inherent value to the donor. Donors are not in any way to be perceived of “subsidizing” either the Cadet Program or the individual cadet.
• 6.3 CJCR Gp personnel have a responsibility to act in a transparent manner when conducting fundraising activities, therefore donors must be made aware of the exact purpose of the fundraising activity. COATS members are to ensure that messaging and communications regarding any fundraising activity clearly identify the intended purpose and recipients of the funds.
• 6.4 When corps/squadrons communicate or sell goods for the purpose of fundraising in support of a charity, they will use the badge/identification of the charity and make clear to donors that the fund raising is for a third party. 

Wearing of Uniforms

• 6.5 Uniforms may be worn, as appropriate, by cadets and COATS members for approved CJCR Gp supported charitable activities to include fundraising.

7. Safety and Security

• 7.1 The safety and security of cadets is paramount. Supervision of cadets participating in charity or fundraising activities must be in accordance with CJCR Gp Order 5001-0, Supervision of Cadets.
• 7.2 COATS members and cadets will not be responsible for or handle monies on behalf of the charities, other than initial acceptance of the monies at the point of donation and the transfer of collected monies to the charity.

8. Publication

Frequency of Publication

• 8.1 A periodic review of CJCR Gp Orders will be initiated every three years, or more frequently if necessary.

Errors/Omissions or Suggestions

• 8.2 Users of CJCR Gp Orders are encouraged to bring any errors, omissions or suggested orders to the attention of CJCR Gp HQ J1 Policy.
