3. Definitions

Individual Training and Education.

A set of activities intended to develop the competencies, skills, knowledge and attitudes a CAF member requires to perform assigned tasks, correctly interpret information and exercise sound judgement. (Defence Terminology Bank record number 42483)

Official Language.

The English or French language. (Defence Terminology Bank record number 43159)

Unreasonable Delay.

A delay in access to training in an individual's official language of choice that exceeds the time normally required to provide equivalent training in the other official language, taking into account operational requirements and available course offerings.

4. Policy

Context

• 4.1 Adult IT&E participants are entitled to receive training and education in the official language of their choice, consistent with the principles of DAOD 5039-6, Canadian Armed Forces Training and Education in Both Official Languages. This entitlement applies equally to CAF members, and CIs. Participants will have access to training in their official language of choice regardless of geographic location. A participant's preferred official language of training takes precedence over geographic proximity or travel-minimization considerations. Where necessary, travel or other measures shall be authorized to meet official languages requirements and training needs.
• 4.2 DAOD 5039-6, Canadian Armed Forces Training and Education in Both Official Languages applies only to CAF members. This order exists to extend the same principles and rights to CIs, who deliver and support the Cadet and JCR programs.

Policy

• 4.3 To give effect to this entitlement, official languages considerations will be integrated into all CJCR Gp controlled Adult IT&E sessions.
• 4.4 The objective of this order is to support Adult IT&E in which all eligible participants have equitable access to training opportunities, instructional materials, assessments, and certification processes regardless of their official language of choice, and in which no participant experiences an Unreasonable Delay in accessing training in their official language of choice.
• 4.5 CJCR Gp Training Establishments and Other Training Authorities will monitor and report, at the frequency and in a format directed by Comd CJCR Gp, the data on access to training by official language, to ensure equitable access to training opportunities and enable the early identification and resolution of disparities before Unreasonable Delays develop.
• 4.6 Any deviation from this policy requires approval from Comd CJCR Gp or designated authority, documented together with the operational justification for the deviation.

Requirements

• 4.7 A member or CI, who believes their right under this order has not been met, may raise the matter through their chain of command to the applicable CJCR Gp TE or OTE in the first instance, and, if unresolved, to Comd CJCR Gp. CJCR Gp organizations will respond to a matter raised under this paragraph within a reasonable time.

Responsibilities

• 4.8 Comd CJCR Gp is accountable for ensuring Adult IT&E achieves equitable access, development, delivery, assessment and evaluation in both official languages, including approval of the annual COATS IT&E training plan and compliance oversight with official languages obligations.
• 4.9 CJCR Gp Training Establishments and Other Training Authorities are accountable for ensuring Adult IT&E programs under their authority achieve equitable access, delivery, and evaluation in both official languages, consistent with this order and DAOD 5039-6, Canadian Armed Forces Training and Education in Both Official Languages. They will plan, schedule, and resource course offerings in English, French, or bilingual formats as required to ensure participants have access to training in their official language of choice and do not experience an Unreasonable Delay. When multiple course offerings exist in the same official language, course loading may be managed to support the efficient use of resources, provided such decisions remain fully compliant with official languages obligations and do not result in an Unreasonable Delay in access to training in the participant's official language of choice.
• 4.10 Supervisors and course staff will support participants in exercising their official language of choice throughout training and assessment activities and will bring any concern raised to the attention of the applicable TE or OTE without delay.
• 4.11 Members are accountable for identifying their official language of choice for IT&E and other training and educational activities prior to attendance, to ensure timely and accurate delivery of training in their preferred official language.

5. Course Development

• 5.1 Training materials, assessments, course documentation, and supporting instructional resources for newly developed or substantially revised Adult IT&E courses will be available in both official languages prior to course delivery.
• 5.2 Course design will ensure that learning objectives, instructional content, assessment standards, and certification requirements are equivalent in both official languages.

6. Course Delivery

• 6.1 Instruction, learner support, assessments, and evaluation activities shall be provided in the participant's official language of choice. Participants shall be trained in their official language of choice regardless of geographic location. Training authorities shall schedule course offerings in English, French, or bilingual formats to ensure access to training in both official languages. A participant's preferred language of training takes precedence over geographic proximity or travel-minimization considerations.
• 6.2 Successful completion of training and the awarding of qualifications, certifications, or other recognition will not be affected by the participants official language of choice.

7. Publication

• 7.1 Publication and review of CJCR Gp Os and CJCR Gp Instructions is conducted in accordance with CJCR Gp O 1000-0, Foundation Framework for CJCR Gp Orders and Instructions.

Frequency of Publication

• 7.2 A periodic review of each CJCR Gp O and each CJCR Gp Instruction will be initiated every 5 years, or more frequently if necessary.

• 7.3 Readers of CJCR Gp Os and CJCR Gp Instructions are encouraged to identify any errors, omissions or suggested orders to the attention of CJCRPol-PolCRJC@forces.gc.ca.
