History:

REGULATIONS RESPECTING RETROACTIVE REMUNERATION PAID TO MEMBERS OF THE CANADIAN FORCES

Approved by T.B. 806934 of 26 November, 1987

Short Title

1. These Regulations may be cited as the Retroactive Remuneration Regulations – Canadian Forces.

Interpretation

2. For the purposes of these Regulations,

"member" (militaire)
means any officer or non-commissioned member of the Regular or Reserve Force of the Canadian Forces;
"remuneration" (rémunération)
means pay and allowances and includes any other form of compensation payable to or in respect of a member that is determined from time to time by Treasury Board to be subject to these Regulations; and
"retroactive period" (période de rétroactivité)
means the period commencing on the effective date of the retroactive upward revision in remuneration and ending on the day approval is given.

Retroactive Upward Revision

3. A retroactive upward revision in remuneration shall apply to a member, a former member or in case of death, the estate of a former member who was serving in the Canadian Forces during the whole or any portion of the retroactive period.

4. When a retroactive upward revision in remuneration is approved, retroactive remuneration shall be paid in an amount equal to what would have been paid had the revision been approved on the effective date, less the amount that was actually paid between the effective date the day approval is given.

Payments

5. The Canadian Forces, as employer, shall initiate payment to a member, a former member or, in case of death, the estate of a former member who is eligible for retroactive remuneration.

6. No payment shall be made pursuant to these Regulations in an amount of one dollar or less.
